Welcome to Jobzy (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, platform, and services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

(Note:) We are in the process of formalizing our business registration (ABN/ACN details will be updated as soon as available).

1. Acceptance of Terms

1.1 Binding Agreement

By creating an account, clicking “I Agree,” or otherwise using the Platform, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately.

1.2 Electronic Communications

When you use the Platform or send us emails, you are communicating electronically. You consent to receive communications (e.g., emails, in-app notices, Platform notifications) from us electronically. You also agree that all agreements, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing.

2. Eligibility and Jurisdiction

2.1 Age Requirements

The Platform is intended for individuals 18 years of age or older. If we discover that anyone under 18 is using the Platform without valid parental or guardian consent, we may delete their account and all associated data. If you are aware of such usage, please contact us at support@jobzy.ai.

2.2 International Access

Jobzy is operated from Australia and is accessible worldwide. It is your responsibility to ensure that your use of the Platform complies with all applicable laws and regulations in your jurisdiction. If local laws impose additional requirements, you must comply with them. In jurisdictions where any provision of these Terms is illegal or unenforceable, you are not authorized to use the Platform.

2.3 No Employment Agency

Jobzy is not an employment agency or recruitment firm, and we are not licensed as such in any jurisdiction. We do not represent or act on behalf of employers or job seekers in an employer-employee or recruiter-candidate relationship.

3. Account Registration and Management

3.1 Account Creation

To access certain features, you must create an account by providing a valid email address, password, and any requested information. You agree to provide accurate, current, and complete information and update it as necessary.

3.2 Email Verification

You must verify your email address before accessing the full range of services. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3.3 Consent to Communications

By creating an account, you consent to receive transactional and administrative emails (e.g., payment receipts, account notices). For marketing communications, we will seek your explicit opt-in, in accordance with the Australian Spam Act 2003 and other applicable spam laws. You may unsubscribe from marketing emails at any time.

3.4 Account Modification and Deletion

To modify or delete your account, email us at support@jobzy.ai. We will process your request in accordance with our Privacy Policy. Upon deletion, your personal data will be handled as described in our Privacy Policy, and you may lose access to all associated content or data. We commit to processing such requests within a reasonable timeframe.

4. Services and AI Technology

4.1 AI-Driven Job Recommendations

Jobzy uses AI algorithms to suggest potential job opportunities based on the information you provide (e.g., skills, resume content). These recommendations are provided for informational purposes only and do not constitute a guarantee of employment or professional advice.

4.2 Accuracy, Limitations, and User Discretion

While we strive to provide high-quality recommendations, our AI technology may occasionally produce inaccurate or incomplete results. You agree to exercise your own judgment, verify information independently, and not rely solely on the AI recommendations when making career decisions.

4.3 No Automatic Applications

We will not submit applications on your behalf without your explicit consent. You are responsible for reviewing positions, submitting applications, and communicating with potential employers.

4.4 Monitoring, Bias, and Feedback

We continually work to monitor and reduce bias in our AI algorithms. Although we make efforts to refine our models, we cannot guarantee complete elimination of bias or error. We welcome your feedback to help us improve these systems.

5. User Conduct and Responsibilities

5.1 Accurate Information

You agree to provide true, current, and complete information (e.g., resumes, profiles) and are solely responsible for any content you submit.

5.2 Prohibited Activities

  • Use the Platform for unlawful, fraudulent, or deceptive activities.
  • Violate any applicable laws, regulations, or these Terms.
  • Impersonate others or misrepresent your affiliation with any person or entity.
  • Upload or distribute viruses, malware, or any other harmful code.
  • Engage in unsolicited advertising, spam, or phishing.
  • Interfere with the Platform's performance, security, or functionality.
  • Bypass any access or use restrictions on the Platform.

5.3 Suspension, Termination, and Appeal

We reserve the right to suspend or terminate your account if we suspect or determine you have violated these Terms. Any such action will be communicated to you along with an explanation and information on how to appeal the decision if you believe it to be in error. Termination does not affect rights accrued prior to termination.

6. Paid Subscriptions and Billing

6.1 Subscription Plans

We may offer paid subscriptions that provide additional benefits (e.g., priority matching). The details, fees, and billing schedules for such subscriptions will be clearly described on the Platform.

6.2 Billing, Auto-Renewal, and Cancellation

All fees are quoted in Australian Dollars (AUD) unless stated otherwise and may include GST where applicable. If you opt in for auto-renewal, you authorize us or our payment processor (e.g., Stripe) to charge your chosen payment method at the start of each billing cycle until you cancel. Cancellation instructions and the process to disable auto-renewal will be provided in your account settings and our help documentation.

6.3 Price Changes

We reserve the right to adjust subscription fees. Should we make material changes, we will notify you at least 30 days in advance. If you disagree with the new fees, you must cancel your subscription before the changes take effect.

7. Refund Policy

7.1 Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies rights or remedies you may have under the Australian Consumer Law or any other non-excludable laws.

7.2 Refund Eligibility

Unless required by law, we generally do not offer refunds except in cases of significant service failures under the ACL. If you believe your situation qualifies for a refund, please email support@jobzy.ai with "Refund Request" in the subject line.

7.3 Process and Timeline

Upon receiving your refund request, we will review it and, if approved, issue a refund to your original payment method within a reasonable timeframe. We do not guarantee prorated refunds for partially used subscription terms unless mandated by law.

8. Third-Party Content and Job Listings

8.1 Third-Party Websites

The Platform may contain links to external websites or services. We do not control, endorse, or take responsibility for the content, privacy practices, or security of these third-party sites.

8.2 Job Postings Provided by Third Parties

Job postings and related content may be provided by third parties. While we strive to provide accurate information, we do not verify the accuracy, legality, or legitimacy of these postings. You are advised to exercise due diligence before submitting any applications or personal information.

8.3 Reporting and Due Diligence

If you encounter suspicious or fraudulent job postings, please report them immediately to support@jobzy.ai. You are ultimately responsible for vetting job opportunities and confirming details independently.

9. Data Privacy and Cross-Border Transfers

9.1 Privacy Policy

Your use of the Platform is subject to our Privacy Policy, which details how we collect, store, use, and disclose your personal data. By using the Platform, you consent to these practices.

9.2 International Data Transfers and Security Safeguards

We may store or process your data outside Australia (e.g., via service providers such as Supabase). In such cases, we implement industry-standard safeguards to protect your data and comply with relevant data protection laws (including the Australian Privacy Principles and, where applicable, GDPR). A data processing addendum is available upon request.

9.3 Children's Data

We do not knowingly collect personal data from individuals under 18. If you become aware that a minor has provided personal data without proper consent, please contact us at support@jobzy.ai so that we may promptly delete such data.

10. Intellectual Property

10.1 Ownership

All content, trademarks, and intellectual property on the Platform (collectively, "Content") are owned by or licensed to Jobzy. You are granted a limited, non-exclusive right to access and use the Platform solely for its intended purpose.

10.2 User-Generated Content and Licensing

By uploading or submitting documents (e.g., resumes) or other materials ("User Content"), you retain ownership of your content. However, you grant Jobzy a limited, non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute your content solely for the purpose of operating and improving the Platform. This license does not transfer any broader rights in your content.

10.3 Copyright Infringement

If you believe that any User Content infringes your copyright or other intellectual property rights, please notify us immediately at support@jobzy.ai. We will investigate the claim and remove any content found to be infringing.

11. Warranties and Disclaimers

11.1 "As Is" / "As Available"

To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis. Except as required by non-excludable rights under the Australian Consumer Law (or any other applicable law), we disclaim all express and implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11.2 No Guarantee of Employment

Jobzy makes no guarantees regarding job outcomes, the credibility of employers, or the success of any applications. You acknowledge that any decisions you make based on AI recommendations or job postings are at your own risk.

11.3 Limitation on Statutory Guarantees

Where applicable law does not permit the exclusion or limitation of liability, nothing in these Terms shall exclude or limit such liability (including liability for personal injury or death caused by our negligence).

12. Limitation of Liability

12.1 Extent of Liability

Subject to non-excludable rights under applicable law, Jobzy and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of the Platform.

12.2 Cap on Damages

Where liability cannot be excluded, our liability will be limited, at our discretion, to either re-supplying the service or reimbursing the cost of having the service re-supplied, in accordance with applicable law.

12.3 Third-Party Disputes

We are not responsible for disputes between users or between users and third parties (including employers). Any such disputes should be resolved directly with the involved parties.

13. Indemnification

You agree to indemnify and hold harmless Jobzy, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • (a) your violation of these Terms;
  • (b) your use or misuse of the Platform;
  • (c) your User Content;
  • (d) your infringement of any third-party rights.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of Australia (and, where applicable, South Australia) without regard to its conflict of laws principles. If you reside outside Australia, you may have additional rights under local consumer protection laws.

14.2 Initial Resolution and Mediation

In the event of a dispute, both parties agree to first attempt to resolve the matter amicably through direct negotiation. If a resolution cannot be reached within 30 days, we may engage in mediation in Adelaide, South Australia. Detailed mediation procedures will be provided upon request.

14.3 Jurisdiction

If mediation fails, you agree that the courts located in Adelaide, South Australia, shall have exclusive jurisdiction over any disputes, unless a court of competent jurisdiction orders otherwise.

15. Changes to Terms

15.1 Right to Modify

We reserve the right to amend these Terms at any time. For material changes, we will notify you (e.g., by email or via a notice on the Platform) at least 30 days before the changes take effect. We will also provide details on how the changes affect your rights and obligations.

15.2 Acceptance of Changes

Your continued use of the Platform after the updated Terms become effective constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Platform.

16. Suspension and Termination

16.1 Termination by You

You may terminate your account at any time by contacting support@jobzy.ai. Termination will not affect rights or obligations accrued prior to termination. Please note that account termination may result in the deletion of your personal data as described in our Privacy Policy.

16.2 Termination by Us

We may suspend or terminate your account for any reason, including suspected violations of these Terms or fraudulent activity. If your account is suspended or terminated, we will provide an explanation and information regarding the appeal process, where applicable.

16.3 Survival

Provisions that by their nature should survive termination (such as Limitation of Liability, Indemnification, and Dispute Resolution) will remain in effect after your account is terminated.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, represent the entire agreement between you and Jobzy regarding the use of the Platform and supersede any prior agreements or understandings.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17.3 No Waiver

Our failure to enforce any term of these Terms shall not be deemed a waiver of our right to subsequently enforce that or any other term.

17.4 Force Majeure

We shall not be liable for delays or failures to perform our obligations due to causes beyond our reasonable control, including natural disasters, wars, or internet outages.

17.5 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights or obligations under these Terms without notice.
